Pirmado na ng mga lead implementing agencies ang implementing rules and regulations (IRR) ng Republic Act 11596 o ang batas na nagbabawal sa “child marriage” o pagpapakasal sa mga menor-de-edad na babae.
Ayon sa ulat ng CNN Philippines, ang Department of Social Welfare and Development (DSWD) ang nanguna sa pagbalangkas ng IRR katuwang ang ibang ahensya at advocacy group sa pangunguna ng Commission on Human Rights (CHR), Department of Justice (DOJ), United Nations Population Fund, at Oxfam Philippines.
Ang RA 11596 o “An Act Prohibiting the Practice of Child Marriage and Imposing Penalties for Violations Thereof” ay nilagdaan ni dating Pangulong Rodrigo Duterte noong December 2021.
Layon ng naturang batas na protektahan ang mga batang Filipino laban sa abusive practices ng ‘unwanted’ marriage lalo na sa mga paslit na babae na kadalasang makikita sa Bangsamoro Autonomous Region in Muslim Mindanao (BARMM).
Naniniwala ang co-author ng RA 11596 na si Bagong Henerasyon Rep. Bernadette Herrera-Dy na hindi pwedeng ikatwiran na nakadikit na sa kultura ng Pinoy ang “child marriage”.
“Sabi nga natin hindi porke’t tradition or part of culture ay tama. Hindi porke’t kinagisnan ay pwedeng magtuloy-tuloy,” ani Herrera-Dy.
Sa ilalim ng bagong batas, maliban sa multang P40,000, maaari ding makulong ng hanggang sampung taon ang mapapatunayang magpapakasal sa batang bride.
Mas mabigat ang parusa sa mga magulang o guardian na nag-arrange ng adolescent wedding kung saan papalo ito sa 12 taong pagkakabilanggo at multang P50,000.
Katumbas na parusa rin ang maaaring kaharapin ng sinumang pastor o indibidwal na magsasagawa ng child wedding.
Ayon sa datos ng UNICEF noong 202, aabot sa 12 million adolescent girls ang napilitang pumasok sa child marriage kada taon.
