Naglabas ng disqualification order ang second division ng Commission on Elections (COMELEC) laban kay incumbent Cagayan Governor Manuel Mamba dahil sa isyu ng iligal na pamamahagi ng pera ng gobyerno noong kasagsagan ng 2022 elections.
Ayon sa inilabas na press statement ng Comelec ngayong araw, Dec. 15, iginiit ng poll body na nilabag ni Mamba ang 45-day ban sa disbursement ng public funds habang umiiral ang election period.
Sa ilalim ng Sec. 2 ng Comelec Resolution No. 10747, malinaw umano ang mandato ng batas na bawal maglabas, mag-disburse o gumastos ng anumang government fund mula March 25, 2022 hanggang May 8, 2022.
Inilabas ang disqualification order laban sa gobernador sa pamamagitan ng 18-page ruling ng Comelec 2nd Division na pinamumunuan ni Presiding Commissioner Marlon S. Casquejo, Commissioner Rey E. Bulay at Commissioner Nelson J. Celis.
“WHEREFORE, premises considered, the Petition is GRANTED. Respondent MANUEL N. MAMBA is DISQUALIFIED as a candidate for the position of Governor of the Province of Cagayan in the 09 May 2022 National and Local Elections,” pagsipi sa desisyon ng Comelec.
Ang protesta laban kay Mamba ay inihain ng nakalaban nito sa pagka-gobernador noong May 2022 elections na si Ma. Zarah Rose Lara.
Inakusahan ni Lara si Mamba ng malawakang “vote-buying” sa pamamagitan ng pamumudmod ng pondo sa ilalim ng programang “No Barangay Left Behind”, “No Town Left Behind”, at “Oplan Tulong sa Barangay”.
Ipinilit umano ni Mamba ang pamumudmod ng pondo sa kabila ng inilabas na Temporary Restraining Order (TRO) ng Regional Trial Court Branch 5 ng Tuguegarao City, Cagayan na bawal galawin ang pondo para sa mga naturang proyekto.
Binigyan ang gobernador ng limang araw na palugit para maghain ng kanyang motion for reconsideration (MR) para i-apela ang desisyon ng Comelec.
