Pinaboran ng Supreme Court ang petisyon ng limang “illegally dismissed” riders laban sa kanilang employer na Lazada E-Services Philippines, Inc. (Lazada).

Iniutos ng Korte Suprema sa e-commerce company na ibalik sa mga petitioner ang kanilang dating posisyon bilang mga riders, gayundin ang mabayaran ang kanilang mga benepisyo at backwages mula sa oras ng tinanggal sila sa trabaho hanggang sa oras na muli silang makabalik.

Pebrero 2016, nang ma-hire ang limang riders ng Lazada. Ayon sa nakasaad sa kanilang mga kontrata, babayaran umano sila ng tig-P1,200 kada araw sa loob ng isang taon.

Subalit, Enero 2017, sinabi ng kanilang dispatcher na tinanggal sila sa kanilang mga ruta at hindi na muling bibigyan ng schedule. Napag-alaman nila na binigay na sa iba ang kanilang ruta sa ibang empleyado.

Ito ang nagtulak sa mga riders na magsampa ng kaso sa National Labor Relations Commission (NLRC). Depensa nila, na sila’y mga regular na empleyado ng e-commerce site. Ngunit, mariin itong itinanggi ng kumpanya at sinabing sila ay mga independent contractors.

Ibinasura ng Labor Arbiter ang reklamo ng mga riders, gayundin ng NLRC at Court of Appeals.

Muling inilaban ng mga riders ang kanilang kaso at itinaas itinaas ito sa Supreme Court.

Dito napag-alaman na nabigo ang Lazada na ipakita ang no employer-employee relationship sa pagitan ng mga couriers at Lazada.

Natuklasan din ng korte na ang mga courier ay direktang tinanggap ng mga nasabing kumpanya.

Sa isang 24-pahinang ruling iniutos ng SC sa Lazada E-Services Philippines, Inc. na muling ibalik sina Chrisden Cabrera Ditiangkin, Hendrix Masamayor Molines, Harvey Mosquito Juanio, Joselito Castro Verde, at Brian Anthony Cubacub Nabong.

Ibinalik din ng SC ang naturang kaso sa arbiter ng NLRC para sa computation ng kanilang makukuhang benepisyo, na may interes na 6% kada taon mula nang isapinal ang desisyon, hanggang sa ganap na sila ay mabayaran.
