Dahil umano sa mga natatanggap na pagbabanta sa kanyang buhay, nagdesisyon si Erwin Ogario na isuko ang sarili sa harap ni Director Brig. Gen. Rommel Francisco Marbil ng Police Regional Office 8 sa Tacloban City.
Matapos umano siyang madismis sa serbisyo noong 2017, nagtago si Ogario sa Eastern Samar kasama ang kanyang pamilya.
Binasa ni BGen. Marbil ang laman ng warrant of arrest ni Ogario sa violation of Section 4 (importation) ng Republic Act 9165 o Comprehensive Dangerous Drugs Act of 2002 na inisyu noong Enero 3, taong 2019 ni Judge Elvira Panganiban ng Quezon City Regional Trial Court Branch 227.
Agad na ididiretso si Ogario sa Quezon City upang harapin ang kanyang asunto.
