Ibinasura ng Commission on Election (Comelec) Second Division ang petisyon na i-disqualify si dating Department of Social Welfare and Development (DSWD) Secretary Erwin Tulfo bilang nominee ng Anti-Crime and Terrorism Community Involvement and Support (ACT-CIS) Party List.
Ayon sa resolusyon ng Comelec, ang anumang petisyon laban sa isang party list candidate ay dapat maihain bago ang proklamasyon nito.
Naiproklamang panalo ang ACT-CIS noong May 26, 2022. Ang petisyon naman laban kay Tulfo ay inihain noong March 1, 2023 ng isang abogado na si Atty. Moises Tolentino.
“In this case, nothing in the law and rules grant upon the Commission the jurisdiction to act on the instant petition for disqualification because the same was filed beyond the period prescribed under the rules,” ayon sa statement ng Comelec.
Humakot ang ACT-CIS ng 2,111,091 votes noong nakaraang eleksyon, ang pinakamataas sa lahat ng Party List candidates na nagbigay sa kanila ng tatlong seats sa Kongreso.
Si Tulfo ang fourth nominee ng ACT-CIS ngunit awtomatikong uupo bilang third nominee matapos magbitiw sa pwesto ang original third nominee ng partido na si Jeffrey Soriano. Pormal nang tinanggap ng House of Representatives ang resignation ni Soriano noong February 2023.
